BrewHQ Terms of Service

Last updated 6 October 2026.

These terms govern use of BrewHQ, the brewery management service at brewhq.app, provided by BrewHQ LLC, an Illinois limited liability company ("BrewHQ", "we", "us"). By creating an account, accepting an invitation to a brewery, or using the service, you agree to them on your own behalf and on behalf of the brewery you act for. If you do not have authority to bind that brewery, do not use the service.

1. The service

BrewHQ is software for running a brewery: production records, inventory, sales and distribution, taproom depletion from a connected point of sale, accounting exports, and figures assembled for regulatory filings. It is provided as an online service. We may add, change or remove features, and we will tell you in advance where a change removes something you rely on.

2. Accounts and access

2.1 Breweries and people. A brewery is an account that holds its own data. People get into it by being added by an owner or admin of that brewery. Each person has their own login; sharing a login is not allowed, because everything recorded is attributed to the person who recorded it.

2.2 Your responsibilities. You are responsible for keeping your password and second factor secure, for who you add to your brewery and the roles you give them, and for everything done through your brewery's accounts. Tell us at once if you believe an account has been compromised.

2.3 Access during the pilot. While BrewHQ is in pilot, new breweries are created with an access code we issue. A code is for the brewery it was issued to. We may close pilot access to a brewery that uses the service in a way these terms do not allow.

2.4 Minimum age. You must be at least 18 to use BrewHQ.

3. Fees

3.1 Price. BrewHQ is priced per brewery, with no charge per person. There are two brackets by annual production: breweries making under 2,000 barrels a year, and breweries making 2,000 barrels a year or more. Current prices for each, monthly and yearly, are shown at brewhq.app and under Billing in the service. Prices exclude sales tax, which we add where the law requires it.

3.2 Free trial. A new brewery gets a free trial, 30 days unless an access code issued by us says otherwise. Without an access code, a payment card is taken first and the brewery is created when the card is confirmed; the card is not charged until the trial ends. A trial started with an access code requires no card. If no subscription is in place when a trial ends, the brewery becomes read-only after a short grace period, and its data remains available to view and export.

3.3 Automatic renewal. Subscriptions renew automatically at the end of each monthly or yearly period, and the card on file is charged, until you cancel. You can cancel at any time under Billing; access continues to the end of the period already paid for. We send a reminder before a trial converts to a paid plan and before each yearly renewal.

3.4 Changes in price or bracket. We will give at least 30 days' notice before a price change takes effect for your brewery. Your bracket is checked against the production recorded in the service; a change of bracket takes effect at your next renewal, with notice, never mid-term.

3.5 Refunds. Fees are non-refundable except where the law requires. If you cancel, you keep access to the end of the paid period.

4. Your data

4.1 Ownership. Everything your brewery enters or generates in BrewHQ, including recipes, batch records, inventory, customers, sales and reports, is your brewery's data. You own it. We claim no rights in it beyond those needed to run the service for you.

4.2 Our use of it. We use your data only to provide, secure, support and improve the service. We do not sell it, and we do not share it with other breweries. We may use data in aggregated or anonymised form that does not identify your brewery, its people or its customers, for example to size infrastructure or understand which features are used.

4.3 Your responsibilities for it. You are responsible for the accuracy of what is entered and for having the right to enter it, including personal details of your customers and staff. Where you enter personal data, you are its controller and we process it for you under the Data Processing Terms, which form part of these terms.

4.4 Where it lives. Your data is stored in the United States with our hosting providers. Backups are taken daily and kept for seven days.

4.5 Confidentiality. We treat your data as confidential and limit access to those who need it to run or support the service. We will not look at the contents of your brewery's records except to resolve a problem you have raised, to investigate a security incident or abuse, or where the law requires.

5. Regulatory figures are your responsibility

This section matters more than any other. Read it.

5.1 What the reports are. BrewHQ assembles figures for the TTB Brewer's Report of Operations, the federal excise tax return and state beer excise returns from the movements your team recorded. These figures are a bookkeeping aid. They are not tax, legal or accounting advice, and BrewHQ does not file anything with any agency on your behalf.

5.2 What they depend on. The figures reflect your records exactly as entered, including any errors, omissions or late entries. Tax rates, thresholds and form layouts change; the rates and layouts in BrewHQ were current as of the date shown beside them and may be out of date.

5.3 Your obligation. Your brewery is solely responsible for reviewing the figures against its own records, correcting them, transcribing them to the official forms, filing on time and paying what is due. Before marking a return filed in BrewHQ you confirm that you have done this review. We strongly recommend that returns are checked by a person qualified to do so.

5.4 No liability for filings. To the fullest extent the law allows, BrewHQ is not liable for any tax, penalty, interest, fine, assessment or other consequence of a filing made using figures from the service, whether the figures were right or wrong.

6. AI features

Some features use a third-party language model to read documents you upload, such as supplier price lists and customer purchase orders, and to answer questions about your brewery's data. Documents and questions are sent to the model provider to be processed and are not used by the provider to train its models under our agreement with them. The model's output can be wrong. Anything it extracts or suggests is a draft for a person to check before it is relied on, and the limits in section 5 apply to any figure it produces. We may limit how much of these features a brewery can use.

7. Integrations

BrewHQ connects to third-party services you authorise, currently Square, Xero and QuickBooks Online. Each connection acts only within the permissions you grant and can be disconnected at any time. Those services have their own terms, and we are not responsible for their availability, their data or changes they make. Where BrewHQ writes to them, for example an invoice or a stock count, you remain responsible for reviewing those records in that service.

8. Acceptable use

You will not use BrewHQ to break the law, to store data you have no right to store, to attempt to reach another brewery's data, to probe or overload the service, to resell it, or to build a competing product by copying it. You will not remove or obscure notices in the service. We may suspend access that we reasonably believe breaches this section, and we will tell you why.

9. Term, termination and taking your data

9.1 Leaving. You may stop using BrewHQ at any time. An owner can export every main list as a spreadsheet from within the service, and on request we will provide a complete export of your brewery's data within 14 days.

9.2 Termination by us. We may end a brewery's access on 30 days' notice for any reason, or immediately for a material breach of these terms, for non-payment once fees apply, or where continuing would be unlawful or unsafe. We will provide the export in section 9.1 in every case except where the law prevents it.

9.3 After the end. We keep your data for 30 days after access ends so it can be exported, then delete it from live systems, with backups expiring in the ordinary course. Sections 4, 5, 10, 11, 12 and 13 survive termination.

10. Availability, support and changes

We aim to keep BrewHQ available at all times but do not guarantee uninterrupted service. We may take it down for maintenance, with notice where practical. Support is by email at support@brewhq.app ; we aim to respond within one business day, Monday to Friday, Central time. We may change these terms; we will give at least 30 days' notice of material changes by email and in the service, and continued use after that is acceptance. If you do not accept a change you may leave under section 9.1.

11. Disclaimers

The service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service will be error-free, that any figure will be accurate, or that data will never be lost, and you should keep your own records.

12. Limitation of liability

To the fullest extent the law allows:

12.1 BrewHQ is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, lost data, or regulatory penalties, however caused.

12.2 BrewHQ's total liability for all claims arising from or related to the service in any twelve-month period will not exceed the greater of the fees your brewery paid us in that period and one hundred US dollars ($100).

12.3 Nothing in these terms limits liability that cannot be limited by law, including for fraud or for death or personal injury caused by negligence.

13. Indemnity

Your brewery will defend and indemnify BrewHQ against third-party claims arising from your data, your filings, your breach of these terms, or your use of the service in breach of law, including reasonable legal fees. We will tell you promptly of any such claim and let you control its defence, provided you do not settle in a way that admits fault on our part without our consent.

14. Intellectual property

BrewHQ, its software, design, documentation and the BrewHQ name are ours. You get a limited, non-exclusive, non-transferable right to use the service under these terms. Suggestions you give us about the service may be used without obligation to you. Your data remains yours under section 4.

15. Disputes and governing law

These terms are governed by the laws of the State of Illinois, without regard to conflict-of-law rules. Before starting any proceeding, each side agrees to raise the dispute with the other in writing and spend at least 30 days trying to resolve it. Any proceeding will be brought in the state or federal courts located in the Illinois county where BrewHQ has its principal office, and each side submits to their jurisdiction.

16. General

These terms, with the Privacy Policy and any order form or plan terms, are the whole agreement between us about the service. If a part is unenforceable the rest stands. Neither side is liable for delay caused by events outside its reasonable control. You may not assign these terms without our consent; we may assign them to a successor to the business on notice to you. Notices to us go to support@brewhq.app; notices to you go to the owners' email addresses on your brewery.
